The European Union is unique among international organizations. Among the hallmarks of its special position is the so-called infringement procedure through which the Commission tries to guarantee full and equal application by all Member States of Community law. This makes it all the more remarkable that the European Union recently has gone back to what seem to be at first sight weaker techniques of enforcement, such as peer review and mutual surveillance, or surveillance by an agency. This is in part a consequence of the fact that the relevant norms fall outside the classical Community law area (third pillar, Schengen) or an area that was deemed unsuitable for infringement proceedings (monetary union). However, after some of these norms moved to the Community side of the Union, the techniques were maintained. Moreover, in traditional Community law areas especially the presence of agencies has led to applying surveillance techniques which are supposed to fulfil some of the functions of infringement procedures.

The Ph.D. candidate is expected to make an inventory of the areas of Community law where non-infringement procedures of ensuring application and implementation of Community law have become important, to do a comparative study into comparable techniques used in other international organizations and to arrive at some conclusions with respect to the success of such techniques and under which conditions they can be as effective or more effective than the infringement procedure.

Tasks

To engage in supervised scientific research that will ultimately result in a doctoral thesis;
The candidate may also lecture on subjects in the Faculty’s curriculum.

Requirements

Qualified jurist with excellent knowledge of the law of international organizations and Community law;
Excellent writing skills; fluency in English; good working knowledge of German and/or French preferred;
Passion for research in the field of international law, following the comparative method;
Foreign candidates will be expected to acquire working knowledge of the Dutch language within a period of two years.

Appointment

The appointment will be full time (38 hours a week) although a part-time appointment (32 hours per week) can be facilitated with the consent of the employer, for a period of four years and should lead to a dissertation. The gross monthly salary will be in accordance with University regulations for academic personnel, and will range from € 2.000,- in the first year up to a maximum of € 2.558,- in the last year.
